- No Need to Fly to India: An NRI can sign a valid Power of Attorney from abroad. You do not need to fly to India.
- Apostille vs Embassy Attestation: In Hague nations like the US and UK, a local Notary and Apostille sticker is valid. In Gulf nations, visit the Indian Embassy for consular attestation.
- The Section 18 Stamping Rule: Under Section 18 of the Indian Stamp Act, 1899, you must get the deed stamped within 3 months of its arrival in India.
- Save Courier Tracking Proof: The 90-day clock starts on the day the courier reaches India. Keep your DHL or FedEx envelope and delivery slip.
- Special PoA vs General PoA: Never give a broad General PoA. Give a Special Power of Attorney naming the exact flat, plot, or survey number.
- Presumption Under Law: A properly attested and stamped PoA is presumed genuine under Section 84 of the Bharatiya Sakshya Adhiniyam, 2023.
Many Non-Resident Indians (NRIs) inherit family homes, ancestral land, or shops in India. Managing these assets from abroad is hard. It is difficult to take leave from work in London, New York, or Dubai to stand in long lines at government desks in India.
The best legal path is to give a Power of Attorney (PoA) to a trusted family member or lawyer in India. Your agent can then file mutation forms, pay local taxes, and sign sale deeds on your behalf.
Yet, many overseas deeds face rejection in India. The most common error is the strict 90-day stamping rule. Families often receive the deed in India and leave it in a drawer for months. When they finally take it to the sub-registrar, the officer rejects it. In this guide, we explain how to execute a foreign PoA, follow Section 18 of the Stamp Act, and avoid costly delays.
1. Can an NRI Grant Power of Attorney Without Visiting India?
Yes. Indian law allows you to execute a Power of Attorney while living overseas. You do not need to travel to India to sign the deed.
Three main laws govern foreign deeds: the Powers of Attorney Act, 1882, the Registration Act, 1908, and the Indian Stamp Act, 1899. Section 33 of the Registration Act, 1908 allows an agent to present papers in India if the deed was signed before an Indian Consul or a certified Notary Public abroad.
Also, Section 84 of the Bharatiya Sakshya Adhiniyam, 2023 gives full legal backing to your deed. It states that Indian courts must presume that any PoA signed before a Notary Public or an Indian Consul was duly executed and authenticated.
To enjoy this legal status, you must sign the paper abroad following set diplomatic rules. Then, you must get it stamped after it lands in India.
The Court shall presume that every document purporting to be a power of attorney, and to have been executed before, and authenticated by, a Notary Public, or any Court, Judge, Magistrate, Consul or Vice-Consul, was so executed and authenticated.
2. Special Power of Attorney vs General Power of Attorney
When you handle inherited property in India, you must pick the right type of deed. NRIs usually choose between two main options:
- Special Power of Attorney (SPA): An SPA gives narrow powers for one specific property or task. For example, you can give your brother power solely to update mutation records for your flat, or solely to sign a sale deed for one plot. Once the task ends, the power ends.
- General Power of Attorney (GPA): A GPA gives broad powers over all your legal and money matters. Your agent can buy, sell, borrow, and run your bank accounts without asking you each time.
The Supreme Court of India warns against using open GPAs for real estate. In the case of Suraj Lamp and Industries v. State of Haryana (2012) 1 SCC 656, the Court held that a PoA is not a sale deed. It does not transfer property ownership. To avoid fraud, banks and buyers now insist that an NRI must use a Special Power of Attorney with full property details and strict limits.
3. Apostille vs Indian Embassy Attestation: Which One Do You Need?
How you verify your deed abroad depends on where you live. It depends on whether your host nation belongs to the Hague Apostille Convention of 1961.
India is a member of the Hague Convention. Because of this treaty, papers with a valid Apostille from another member country are accepted in India without visiting an Indian Embassy.
1. Print your drafted PoA on plain white paper.
2. Sign the deed in person before a local Notary Public with two adult witnesses.
3. Submit the notarized deed to the state office (like the Secretary of State in the US or FCDO in the UK) for an Apostille sticker.
4. Once the Apostille sticker is added, the deed is ready for use in India.
1. Print your drafted PoA on plain paper in two sets.
2. Book an in-person slot at the nearest Indian Embassy or Consulate.
3. Sign the deed in front of the Consular Officer. Take your passport, visa copy, and photos.
4. The Consular Officer signs, stamps, and seals the paper to confirm your identity.
4. The 90-Day Adjudication Rule: Section 18 Indian Stamp Act, 1899
This is the most vital step in the whole process. It is where most NRI property matters go wrong.
Under Section 3(c) and Section 18 of the Indian Stamp Act, 1899, any deed signed abroad for property in India cannot be used or registered until it is stamped in India.
Section 18 says that every deed signed outside India must be stamped within three months after it is first received in India. If you miss this 90-day window, the Collector of Stamps will impound the deed. You may face heavy penalty fees up to ten times the original stamp duty.
How does the Collector know when the paper arrived in India? The officer looks at your courier receipt.
When you send the original PoA to India via DHL or FedEx, you must keep:
- The physical courier envelope showing the delivery barcode and dates
- The Airway Bill receipt
- The online tracking printout showing the exact delivery day in India
Your agent takes these papers to the District Collector of Stamps. The Collector checks the foreign stamps, calculates state duty, and affixes the official stamping seal.
5. Foreign Power of Attorney Comparison Matrix
The table below shows how the rules differ across different foreign countries:
| Rule or Step | Hague Nations (US, UK, Canada) | Non-Hague Nations (UAE, Gulf) |
|---|---|---|
| Paper Used Abroad | Plain white A4 or Legal paper | Plain white A4 paper (two sets) |
| Foreign Seal | Local Notary plus State Apostille | Indian Embassy Consular Officer |
| Embassy Visit Needed? | No, an Apostille sticker is enough | Yes, in-person signing is needed |
| Time Limit in India | 3 months (90 days) from arrival date | 3 months (90 days) from arrival date |
| Office in India | District Collector of Stamps | District Collector of Stamps |
| Arrival Proof | Courier bill, envelope, and tracking slip | Courier bill, envelope, and tracking slip |
6. Five-Step Foreign PoA Execution Checklist
Follow these five steps to make sure your overseas deed is accepted in India without delay:
Write down the full property address, survey numbers, and city ward. State clearly if the agent can do mutation, collect rent, or sign a sale deed.
Sign the deed on plain paper in front of two adult witnesses. Add your photo. Complete Apostille in Hague nations or Embassy attestation in the Gulf.
Send the original signed deed to India via tracked courier. Save the courier envelope and tracking receipt to prove the day it reached India.
Your agent presents the deed to the District Collector of Stamps within 90 days. Pay the state stamp duty to receive the official stamp seal.
Your agent takes the stamped deed to the revenue office for mutation or to the sub-registrar for sale registration. Check your taxes using our capital gains tax calculator.
7. Sample Special Power of Attorney Clauses for NRI Property
Here are two clear legal clauses you can use in your Special Power of Attorney:
Note: Put your exact flat number, survey numbers, and municipal ward in the Schedule details.
Note: Banning cash payments keeps your property sale safe and complies with FEMA rules.
8. Why You Must Pair Your PoA with an Indian Will
A Power of Attorney is valid only while you are alive. Under Section 201 of the Indian Contract Act, 1872, an agency ends at once when the principal or agent dies. A PoA cannot give away property after death. It cannot replace a legal Will.
If you own land or a home in India, writing a Will ensures your assets pass easily to your family without court fights. You can draft an Indian Will online in minutes at WillDrafting.in.
